If you missed this post yesterday, here’s the plan: As we all wait for the Supreme Court to rule in Barbara, the case that will determine the fate of birthright citizenship (we discussed the oral argument here. It’s dangerous to try and read tea leaves with this Court but the votes seem to be there to reject Trump’s efforts to write it out of the 14th Amendment), another attack is being mounted against American citizens by the administration, this time against naturalized citizens. My friend Katie Benner, of the New York Times, will join us for a Substack Live to discuss this development on Saturday at 4 p.m. ET. The Times is reporting that DOJ has identified 384 foreign-born, naturalized citizens, whose citizenship it wants to revoke. The suggestion is that this will involve people who have either committed crimes or engaged in some kind of citizenship fraud. But these cases are apparently being assigned to prosecutions, instead of going through DOJ’s Office of Immigration Litigation, which is how they are usually handled. And as a law professor at UVA, Amanda Frost, who is quoted in the article points out, “The government has used this power in the past to target people it views as political opponents.” There’s a lot to discuss here.
