Certified IDR Entity Fee Update


Today, Monday, December 29th, the Department of Health and Human Services (HHS), the Department of Labor (DOL), and the Department of the Treasury (collectively, the Departments) updated the No Surprises Act (NSA) website to reflect the 2026 certified Independent Dispute Resolution (IDR) entity fees in accordance with the Federal Independent Dispute Resolution (IDR) Process Administrative Fee and Certified IDR Entity Fee Ranges Final Rule (IDR Fees Final Rule).

The updated IDR entity fees now published on the NSA website are effective for disputes initiated on or after January 1, 2026. For these disputes, the administrative fee amount is $115 per party per dispute, and the certified IDR entity fee ranges are $200-$840 for single determinations and $268-$1,173 for batched determinations. The website now includes information on the fee set by each certified IDR entity within these ranges.

The IDR Fees Final Rule, effective as of January 22, 2024, set forth the 2025 IDR entity fee ranges, which will remain unchanged for 2026.

IMPORTANT REMINDER

As the Departments continue to make updates to the IDR web form to accommodate guidance-related and system enhancements, we ask that if you have initiated an IDR dispute previously, you clear your computer’s cache or open the IDR initiation web form in a private or incognito window to see all the new features. Do this at least once a week to ensure you see the most up-to-date version of the initiation form. Failure to clear your cache or open this form in private/incognito mode could result in additional follow-up with certified IDR entities or system errors.
