What's going on today?

  • Democratic-led states are inadvertently making their drivers' data available to U.S. immigration authorities through a little-understood digital loophole, a group of lawmakers said. Read their letters to governors here.
  • Three former senior enforcement lawyers at the CFPB are launching a "strategic enforcement project" to help protect the public from corporate misconduct following President Trump's clampdown at the agency, a pro-consumer organization said.
  • OpenAI asked a federal judge to reverse an order that required it to turn over 20 million anonymized ChatGPT chat logs amid a copyright infringement lawsuit by the New York Times and other news outlets, saying it would expose users' private conversations. Read the court filing here.

Does Trump have a defamation case against the BBC?

President Trump threatened to sue the BBC for at least $1 billion over its airing of what he says was a deceptively edited documentary, but the case could hinge on whether anyone in Florida watched it online and felt misled.

If that hurdle is cleared, a U.S. court would need to decide whether Britain's biggest broadcaster intentionally deceived viewers.

My colleague Jack Queen takes a look at what Trump would need to prove and how the BBC could defend itself. Read the explainer here.

After $2.8 billion settlement, class lawyers seek share of next Blue Cross cases

When a federal judge in Alabama finalized a $2.8 billion settlement in antitrust litigation against Blue Cross Blue Shield in August, the award included $759 million in legal fees and costs. It’s a hefty payday, but plaintiffs’ lawyers want more, asking that 12.5% of future payouts in related cases against Blue Cross – matters being litigated by other lawyers – be set aside for them, in recognition of the work they did to build the original case. Jenna Greene has more in On the Case.
