Colombia: New Framework Established for Customs Sanctions, Forfeiture and Administrative Procedures

On June 19, 2026, Law 2586 of 2026 took effect in Colombia, establishing a new legal framework governing customs sanctions, forfeiture, and administrative proceedings for violations of customs obligations and foreign trade regulations. (Law No. 2586 of 2026, art. 1.)The law was enacted in response to the Constitutional Court’s Judgment C-072 of 2025, which declared Decree 920 of 2023 unconstitutional and ordered Congress to adopt a new statutory framework. The court concluded that the customs sanctions regime had to be enacted by Congress rather than under extraordinary presidential legislative authority and deferred the effects of its ruling until June 20, 2026....
